CLASS PACK TERMS
Class Pack Terms

By purchasing, enrolling in, or using a CULTURE. class pack, you acknowledge that you have read, understood, and agree to be legally bound by these Terms & Conditions.
These Terms & Conditions govern all CULTURE. class pack purchases and apply to all group fitness offerings, including but not limited to BOXING., HEROBOARD PILATES., STRENGTH., specialty classes, workshops, and any current or future group fitness programs offered by CULTURE.
These Terms & Conditions supersede all prior class pack policies, agreements, communications, and understandings relating to CULTURE. class packs.

1. ELIGIBILITY & ENROLLMENT
1.1 Age Requirement
Participants must be at least eighteen (18) years of age to independently purchase, register for, or participate in CULTURE. class pack offerings.
Individuals under the age of eighteen (18) are not eligible to independently purchase or utilize CULTURE. class packs. Minors may participate only with prior written authorization from CULTURE., written consent from a parent or legal guardian, and in accordance with any additional participation requirements established by CULTURE.
CULTURE. reserves the right to deny, restrict, or revoke participation or access to any individual at its sole discretion.
1.2 Health Clearance
By purchasing, enrolling in, or participating through a CULTURE. class pack, you expressly represent and warrant that you are in good physical condition and are physically capable of safely participating in all applicable CULTURE. group fitness activities.
You acknowledge that it is your sole responsibility to obtain medical clearance from a licensed healthcare provider regarding any pre-existing medical conditions, injuries, illnesses, pregnancy, medications, or physical limitations prior to participating in any CULTURE. activity.
CULTURE. does not provide medical evaluations, health screenings, medical advice, diagnosis, or treatment and makes no representations or warranties regarding your physical readiness or ability to safely participate.
Participation in any CULTURE. activity is entirely voluntary and at your own risk. You voluntarily assume full responsibility for any injury, illness, adverse health event, disability, property damage, or other loss or damages that may arise directly or indirectly from your participation in any CULTURE. class, event, workshop, or service.

2. CLASS PACK STRUCTURE & BILLING
2.1 Class Pack Access
CULTURE. class packs provide access to eligible group fitness classes based on the class pack purchased. Classes may only be redeemed for eligible classes and services designated by CULTURE.
Available class pack options include:
• DROP IN. – One (1) class for access to one eligible CULTURE. group fitness class.
• FIVE. – Five (5) classes for eligible CULTURE. group fitness classes.
• TEN. – Ten (10) classes for eligible CULTURE. group fitness classes.
Classes have no cash value and may only be redeemed for eligible classes or services designated by CULTURE. class redemption values, eligible services, and available pack options may be modified by CULTURE. at any time for future purchases.
Class availability is subject to scheduling, instructor availability, facility capacity, operational needs, and other business considerations. Purchase of a class pack does not guarantee availability of any specific class, instructor, date, or time.
2.2 Daily Booking Policy
Class pack holders may reserve multiple classes per day, subject to class availability.
To promote fair access during periods of high demand, CULTURE. reserves the right to prioritize participants who have not yet attended a class that day.
CULTURE. further reserves the right to modify booking limits, restrict excessive bookings, limit reservations for high-demand classes, or otherwise manage scheduling in a manner that supports operational efficiency and equitable participant access.
2.3 Class Expiration
Class expiration periods begin on the original purchase date and are automatically applied as follows:
• DROP IN. – Fourteen (14) calendar days
• FIVE. – Forty-five (45) calendar days
• TEN. – Seventy-five (75) calendar days
All classes must be redeemed prior to their expiration date.
Unused, partially used, or expired classes automatically expire and may not be refunded, transferred, redeemed for cash, or reinstated except as expressly provided within these Terms & Conditions.
One-Time Courtesy Extension
As a one-time courtesy, CULTURE. may, at its sole discretion, grant a single forty-eight (48) hour extension for expired classes.
Requests must be submitted within five (5) calendar days following the expiration date.
Approval is entirely discretionary, may be denied for any reason, and shall not establish a precedent for future extensions.
2.4 One-Time Purchase Authorization
CULTURE. class packs are sold as one-time purchases and do not automatically renew.
By completing a class pack purchase, you authorize CULTURE. and its authorized third-party payment processor to charge the payment method provided for the full purchase amount, applicable taxes, and any other authorized charges associated with your transaction.
Separate authorized charges, including but not limited to late cancellation fees, no-show fees, retail purchases, event registrations, or other purchases made after the initial transaction, may be charged to the payment method maintained on your account.
2.5 Payment Processing & Data Security
CULTURE. utilizes secure third-party payment processors to process all class pack purchases and authorized account charges. Payment information is handled in accordance with applicable industry security standards established by the payment processor.
While CULTURE. takes commercially reasonable measures to safeguard participant information, no method of electronic transmission or data storage can be guaranteed to be completely secure. Accordingly, CULTURE. makes no warranty regarding the absolute security of participant information.
To the fullest extent permitted by law, CULTURE. shall not be liable for unauthorized access, data breaches, identity theft, fraudulent transactions, system failures, or other security incidents resulting from circumstances beyond CULTURE.'s reasonable control, including acts or omissions of third-party service providers, payment processors, financial institutions, or the participant's own negligence.
2.6 Payment Disputes & Billing Enforcement
Payment Disputes & Chargebacks
Participants agree to contact CULTURE. directly and make a good-faith effort to resolve any billing concerns prior to initiating a chargeback or payment dispute with their financial institution.
If a chargeback or payment dispute is initiated for a valid CULTURE. charge:
• Any unused class associated with the disputed purchase may be immediately suspended pending resolution.
• A $35 chargeback administration fee may be assessed to cover administrative costs associated with responding to the dispute.
• CULTURE. reserves the right to dispute the chargeback and provide supporting documentation to the issuing financial institution.
• The participant remains financially responsible for all valid purchases, class redeemed, services rendered, products received, event registrations, and any outstanding account balances regardless of the chargeback status.
If classes associated with a disputed transaction have already been redeemed, CULTURE. reserves the right to recover the value of all redeemed services, pursue collection of any outstanding balance, and exercise any other legal remedies available.
Repeated Payment Disputes
Participants who demonstrate a repeated pattern of chargebacks, fraudulent disputes, declined transactions, payment reversals, or other payment-related issues may be prohibited from making future purchases, booking classes, and participating in CULTURE. services, or accessing the facility.
CULTURE. reserves the right to pursue recovery of unpaid balances, collection costs, attorney's fees where permitted by law, and any other remedies available under applicable law.

3. CLASS PACK POLICIES
3.1 Class Extensions & Medical Exceptions
Class packs cannot be frozen, paused, or placed on hold. All classes must be redeemed within the applicable expiration period set forth in Section 2.3.
In limited circumstances involving long-term injury, surgery, pregnancy, military deployment, or other extraordinary circumstances, a participant may submit a written request for a class extension.
Requests must include any documentation reasonably requested by CULTURE. and will be reviewed on a case-by-case basis.
Approval of any class extension is entirely at the sole discretion of CULTURE. and shall not establish a precedent for future requests.
Class extensions cannot be applied retroactively after classes have expired unless expressly approved in writing by CULTURE.
No refunds or cash value will be provided in lieu of unused or expired classes.
3.2 Non-Transferability
Class packs are issued exclusively to the original purchaser and are non-transferable.
Classes may not be sold, assigned, shared, gifted, exchanged, or transferred to another individual without prior written approval from CULTURE.
Classes have no cash value and may not be redeemed for cash, account credit, or any other form of compensation.
CULTURE. reserves the right to deny or revoke any unauthorized transfer of classes and may suspend or terminate account privileges for misuse of class packs or attempts to circumvent this policy.
3.3 Refund Policy
Except as expressly provided in these Terms & Conditions or as otherwise required by applicable law, all class pack purchases, late cancellation fees, no-show fees, retail purchases, event registrations, and other charges are final and non-refundable.
Unused, partially used, or expired classes are not eligible for refunds, cash redemption, account credit, or extensions except as expressly provided in these Terms & Conditions.
Any exception shall be made solely at CULTURE.'s discretion and shall not establish a precedent for future refunds.

4. CLASS BOOKING POLICIES
4.1 Class Booking
All class reservations must be made through CULTURE.'s designated booking platform or app.
Class availability is subject to instructor availability, facility capacity, operational needs, scheduling adjustments, and other business considerations. Purchase of a class pack does not guarantee access to any specific class, instructor, date, or time.
Booking windows, reservation limits, class capacity, and scheduling policies may be modified by CULTURE. at any time.
Walk-in participation is not guaranteed and is subject to class availability and staff approval.
Participants are solely responsible for managing their own reservations, cancellations, waitlist status, and account notifications.
CULTURE. reserves the right to modify class schedules, substitute instructors, change class formats, adjust capacity limits, or cancel classes at any time for operational, safety, staffing, maintenance, or business reasons.
4.2 Cancellations & No-Shows
All class cancellations must be completed through the CULTURE. app or designated booking platform.
Cancellations submitted by email, text message, phone call, social media, direct message, or verbal communication with any CULTURE. team members will not be accepted.
Class reservations must be cancelled at least twelve (12) hours prior to the scheduled class start time.
Late Cancellations
Reservations cancelled fewer than twelve (12) hours before class will incur a $10 late cancellation fee.
No-Shows
participants who fail to attend a scheduled class without cancelling at least twelve (12) hours prior to class will incur a $15 no-show fee.
For class pack holders, the reserved class will remain on the participant's account and may be used toward a future eligible class. The applicable no-show fee will still be charged to the payment method on file.
Late cancellation fees and no-show fees are automatically charged to the payment method on file and are final and non-refundable.
Repeated late cancellations, no-shows, booking abuse, or repeated violations of booking policies may result in temporary booking restrictions, suspension of booking privileges, or denial of future reservations at CULTURE.'s sole discretion.
4.3 Waitlist Policy
If a class reaches capacity, participants may join the waitlist through the CULTURE. app or designated booking platform.
When a space becomes available, eligible participants may be automatically added to the class and notified through the booking platform, app, email, or other available communication method.
It is the participant's responsibility to monitor their waitlist status and cancel their reservation if they are no longer able to attend. Once added to class, all standard cancellation and no-show policies immediately apply.
To promote equitable access during periods of high demand, CULTURE. reserves the right to prioritize participants who have not yet attended a class that day or otherwise adjust waitlist order when reasonably necessary for operational purposes.
Repeated misuse of waitlists, excessive booking behavior, repeated no-shows, or attempts to manipulate reservation availability may result in restricted booking privileges, suspension of account privileges, or denial of future reservations.

5. FACILITY & PARTICIPANT CONDUCT
5.1 Mutual Respect, Accountability & Community
All participants are expected to uphold the standards, values, and culture that define the CULTURE. community.
Participants agree to:
• Treat fellow participants, coaches, staff, guests, and the facility with respect and professionalism.
• Conduct themselves in a manner that contributes to a safe, inclusive, supportive, and positive training environment.
• Accept responsibility for their actions, class participation, facility usage, equipment usage, and adherence to all CULTURE. policies.
Disruptive, abusive, threatening, discriminatory, harassing, intimidating, or otherwise inappropriate conduct toward staff, participants, guests, or visitors will not be tolerated.
CULTURE. reserves the right to issue warnings, remove a participant from any class or the facility, suspend booking privileges, deny future reservations, or terminate participation at any time if a participant's conduct is determined to be inconsistent with the standards, values, or safety of the CULTURE. community.
Any disciplinary action taken under this section shall not entitle the participant to a refund, account credit, reimbursement, or reinstatement.
5.2 Respect for Space & Equipment
CULTURE. is a professionally maintained training facility, and all participants are expected to treat the space, equipment, and amenities with care, respect, and accountability.
Participants agree to:
• Use all equipment only for its intended purpose and in accordance with posted instructions or coach direction.
• Return all equipment to its designated location immediately following class or use.
• Wipe down and sanitize equipment after each use using the cleaning supplies provided.
• Refrain from reserving, relocating, modifying, or removing equipment without prior authorization from CULTURE. staff.
• Immediately report any damaged, malfunctioning, or unsafe equipment to a CULTURE. team member.
• Keep walkways, emergency exits, and shared training areas free from personal belongings, equipment, or other obstructions.
Participants are financially responsible for any damage to CULTURE.'s facility, equipment, or property resulting from intentional misconduct, negligence, misuse, unauthorized modification of equipment, or failure to follow facility policies or staff instructions.
CULTURE. reserves the right to remove a participant from class, restrict future bookings, assess reasonable repair or replacement costs, or deny future participation for misuse of equipment, damage to the facility, failure to maintain shared spaces, or failure to comply with this policy.
5.3 Staff Interaction & Authority
CULTURE. coaches, front desk staff, and leadership team are responsible for maintaining the safety, operations, and overall participant experience. Participants are expected to treat all CULTURE. team members with professionalism, courtesy, and respect and to comply with all reasonable instructions provided by staff.
Participants may not:
• Engage in verbal abuse, harassment, intimidation, threats, discrimination, or disruptive behavior toward any CULTURE. team member or participant.
• Interfere with, interrupt, or undermine the responsibilities of CULTURE. staff.
• Coach, instruct, correct, physically train, or provide unsolicited training advice to other participants unless expressly authorized by CULTURE.
• Conduct personal training, group instruction, business solicitation, or promotion of outside services within the facility without prior written approval from CULTURE.
• Refuse to comply with reasonable staff instructions related to safety, facility operations, equipment usage, scheduling, or enforcement of these Terms & Conditions.
All decisions made by CULTURE. staff regarding safety, class operations, equipment usage, scheduling, or policy enforcement are final while on CULTURE. premises.
Failure to comply with staff direction or violation of this section may result in immediate removal from class or the facility, suspension of booking privileges, denial of future reservations, or any other action deemed appropriate by CULTURE. No refund or account credit will be issued as a result of disciplinary action taken under this section.
5.4 Attire & Hygiene
To promote a safe, professional, and enjoyable training environment, all participants are expected to maintain appropriate attire and personal hygiene while participating in CULTURE. classes and services.
Participants are required to:
• Wear clean, appropriate athletic clothing suitable for the activities being performed.
• Wear closed-toe athletic shoes while participating in STRENGTH., BOXING., or any class where athletic footwear is required.
• Wear socks or grip socks while participating in HEROBOARD PILATES. or any class where footwear requirements are designated by CULTURE.
• Wear hand wraps and closed boxing gloves while participating in BOXING. classes. Participants may bring their own equipment or purchase or rent approved equipment through CULTURE., subject to availability.
• Comply with any additional attire or safety equipment requirements established by CULTURE. for specific classes, workshops, specialty events, or programming.
Participants are expected to maintain reasonable personal hygiene, including wearing clean workout attire and using deodorant or other appropriate hygiene products. Participants whose hygiene, attire, or condition creates an unreasonable disruption, health concern, or negative experience for others may be asked to leave class or return at a later time.
CULTURE. reserves the right to deny participation, remove a participant from class, or restrict future bookings if a participant fails to comply with attire, safety equipment, footwear, or hygiene requirements.
5.5 Personal Belongings & Lost Items
Participants are solely responsible for all personal belongings brought onto CULTURE. premises. CULTURE. is not responsible or liable for any lost, stolen, misplaced, or damaged personal property, regardless of where such property is stored or left within the facility.
Participants are encouraged to leave valuables at home whenever possible and to properly secure all personal belongings while attending classes or utilizing the facility.
Participants agree to:
• Store all bags, clothing, phones, and personal items in designated areas and keep walkways, workout spaces, and emergency exits clear at all times.
• Refrain from leaving personal belongings unattended in workout areas, studios, or common spaces.
• Promptly retrieve all personal belongings upon leaving the facility.
Found property will be placed in CULTURE.'s designated Lost & Found area for up to seven (7) calendar days. After that time, unclaimed items may be donated, discarded, or otherwise disposed of at CULTURE.'s sole discretion.
CULTURE. reserves the right to remove unattended personal property that creates a safety hazard, obstructs facility operations, interferes with the participant experience, or restricts access to equipment or designated training areas.
5.6 Substance Use & Intoxication
CULTURE. is committed to providing a safe, professional, and high-performing training environment. Participants are expected to participate in all classes, services, and facility activities in a manner that does not compromise their own safety or the safety and experience of others.
Participants may not attend classes or participate in any CULTURE. service while under the influence of alcohol, cannabis, illegal drugs, or any substance that may impair judgment, coordination, reaction time, or the ability to safely participate.
The possession, use, sale, or distribution of illegal drugs or controlled substances on CULTURE. premises is strictly prohibited and may result in immediate removal from the facility and denial of future participation.
Participants taking prescription medications are responsible for ensuring they are able to safely participate in physical activity. CULTURE. reserves the right to deny participation if an individual appears unable to safely participate, regardless of the cause.
Alcohol may be served at select CULTURE. events; however, disruptive, unsafe, intoxicated, or inappropriate behavior will not be tolerated and may result in immediate removal from the event or facility.
CULTURE. reserves the sole right to deny participation, remove any individual from the premises, restrict future bookings, or deny future participation if staff reasonably believe the individual presents a safety risk, is impaired, or is otherwise unable to safely participate. Any action taken under this section shall not entitle the participant to a refund, account credit, or reimbursement.

6. LIABILITY WAIVER & ASSUMPTION OF RISK
6.1 Participation Waiver
By purchasing a class pack, entering the CULTURE. facility, or participating in any CULTURE. class, workshop, event, or other activity, you voluntarily acknowledge and assume all risks associated with physical exercise and fitness activities, whether known or unknown, including but not limited to the risk of injury, illness, permanent disability, property damage, or death.
You understand and acknowledge that participation in CULTURE. activities, including BOXING., HEROBOARD PILATES., STRENGTH., specialty classes, workshops, and all other fitness offerings involve inherent risks that cannot be eliminated regardless of the condition of the equipment, facility, or any safety precautions provided.
You certify that you are voluntarily participating in all CULTURE. activities at your own risk and accept full responsibility for your physical condition, limitations, exercise participation, equipment usage, and ability to safely participate.
CULTURE. does not provide medical advice, diagnosis, treatment, exercise programming, supervision, or guarantees regarding fitness results or injury prevention. You acknowledge that it is your responsibility to consult with a licensed healthcare provider before participating in physical activity.
To the fullest extent permitted by applicable law, you voluntarily waive, release, discharge, and agree to hold harmless CULTURE., its owners, officers, directors, employees, contractors, coaches, agents, affiliates, successors, and assigns from any and all claims, demands, causes of action, liabilities, damages, costs, or expenses arising out of or relating to your participation in any CULTURE. activity, except to the extent caused by gross negligence or willful misconduct where such limitation is prohibited by law.
This waiver applies to all classes, workshops, specialty programming, competitions, community events, off-site events, and any activity conducted or sponsored by CULTURE.
6.2 Emergency Response & Medical Treatment
In the event of an illness, injury, accident, or other medical emergency occurring while participating in any CULTURE. activity or while on CULTURE. premises, you authorize CULTURE. staff to take reasonable action to protect your health and safety.
Such actions may include, but are not limited to:
• Contacting emergency medical services (911).
• Administering basic first aid within the scope of staff training.
• Contacting your designated emergency contact, if available.
You acknowledge and understand that:
• CULTURE. does not employ licensed medical professionals on-site and does not guarantee the availability, response time, or outcome of emergency medical services.
• Any decision to seek emergency medical assistance will be made in good faith based on the information available at the time.
• You are solely responsible for all medical expenses, emergency transportation costs, hospital charges, physician fees, rehabilitation costs, and any other expenses arising from medical treatment or emergency response.
• It is your responsibility to maintain accurate and current emergency contact information within your participant profile.
To the fullest extent permitted by law, CULTURE. shall not be liable for any acts, omissions, delays, or outcomes relating to emergency response, medical treatment, emergency transportation, or the availability of emergency services.

7. MEDIA RELEASE
By entering the CULTURE. facility or participating in any CULTURE. class, workshop, event, service, or other activity conducted by CULTURE., you acknowledge and consent to being photographed, filmed, recorded, or otherwise captured in visual or audio media for promotional, educational, editorial, commercial, and marketing purposes.
CULTURE. regularly captures photos, videos, and other media to showcase its community, facility, events, and brand experiences across websites, social media platforms, advertisements, email marketing, printed materials, public relations, and other current or future media channels.
You grant CULTURE., its affiliates, successors, assigns, and authorized marketing partners the unrestricted, perpetual, worldwide, royalty-free right to use, reproduce, edit, publish, distribute, display, transmit, modify, and otherwise utilize your name, likeness, image, voice, and appearance in any media now known or later developed without compensation, notification, or further approval.
This consent applies to both individual and group photography or videography.
Participants who wish to opt out of identifiable individual media must submit a written request to hello@culturetwc.com prior to participating. While CULTURE. will make reasonable efforts to honor such requests, participants acknowledge that CULTURE. cannot guarantee exclusion from incidental appearances in crowd shots, background footage, live events, or other media captured in shared spaces.
All photographs, videos, recordings, and other media created by or on behalf of CULTURE. remain the exclusive property of CULTURE. and may be used at CULTURE.'s sole discretion.

8. PARTICIPANT RECORDING & PHOTOGRAPHY
8.1 Personal Use Content
Participants may capture limited photos or videos for personal, non-commercial use provided such recording does not interfere with other participants, staff, facility operations, or the overall participant experience.
Personal recording is permitted only under the following conditions:
• Recording must receive prior approval from a CULTURE. staff member.
• Recording must not disrupt class operations or interfere with other participants' workouts.
• No participant, coach, staff member, or guest may be intentionally recorded without their express consent.
• Equipment, lighting, workout areas, or training zones may not be altered, reserved, or obstructed for the purpose of filming.
• Participants may request assistance from CULTURE. staff with filming; however, staff are under no obligation to provide such assistance.
Participants are encouraged to tag @culture.twc when sharing personal content featuring the CULTURE. facility or experience.
Personal-use recording may not be used for commercial purposes, business promotion, coaching services, paid partnerships, influencer marketing, sponsorships, online coaching, or any activity intended to generate revenue without CULTURE.'s prior written approval.
CULTURE. reserves the right to restrict, suspend, or prohibit photography or recording at any time to protect participant privacy, preserve facility operations, maintain safety, or safeguard CULTURE.'s proprietary programming and intellectual property.
Violation of this policy may result in removal of the content, suspension of recording privileges, booking restrictions, or denial of future participation.
8.2 Commercial Use Content
Any photography, videography, recording, livestreaming, or other content created for commercial, promotional, educational, or business purposes requires prior written approval from CULTURE.
Commercial use includes, but is not limited to:
• Sponsored or paid social media content.
• Influencer marketing campaigns.
• Brand partnerships or collaborations.
• Professional photography or videography.
• Online coaching or fitness programming.
• Educational courses or subscription content.
• Advertising, promotional materials, or business marketing.
• Any content intended to generate revenue or promote a business, product, or service.
Commercial content may only be created through an approved rental, partnership, licensing agreement, or written authorization provided by CULTURE.
Commercial filming is prohibited during normal facility operations or in any area where it interferes with participants, scheduled programming, private training, or facility activities unless expressly authorized by CULTURE.
No portion of CULTURE.'s programming, coaching methods, training systems, music selection, lighting sequences, proprietary systems, branded experiences, or intellectual property may be recorded, reproduced, distributed, taught, or used for commercial purposes without prior written authorization.
Unauthorized commercial recording or use of CULTURE.'s intellectual property may result in immediate removal from the facility, denial of future participation, legal action, injunctive relief, monetary damages, and any other remedies available under applicable law.

9. INTELLECTUAL PROPERTY
All content, programming, class formats, training systems, coaching methodologies, workouts, branding, logos, trademarks, graphics, written materials, videos, photographs, music selections, lighting sequences, cueing systems, educational materials, and all other proprietary materials offered by or through CULTURE. are and shall remain the exclusive intellectual property of CULTURE. or its respective licensors.
This includes, but is not limited to, BOXING., HEROBOARD PILATES., STRENGTH., specialty programming, workshops, coach education, operational systems, and any current or future proprietary modalities developed or licensed by CULTURE.
Participation through a class pack grants participants access to CULTURE.'s proprietary fitness experiences solely for their own personal, non-commercial use. Such participation does not grant any ownership rights, license, or permission to reproduce, teach, record, distribute, or commercially exploit any portion of CULTURE.'s intellectual property.
Participants may not, without prior written authorization from CULTURE.:
• Copy, reproduce, record, photograph, distribute, publish, transmit, display, or create derivative works from any CULTURE. programming or materials.
• Teach, coach, license, sell, sublicense, or otherwise commercially exploit any CULTURE. programming, methodology, class format, or proprietary system.
• Use CULTURE.'s name, logos, trademarks, slogans, graphics, branding, or other intellectual property for personal, commercial, promotional, or business purposes.
• Record or distribute classes, workshops, coach training, or proprietary educational content except as expressly permitted by CULTURE.
Any unauthorized use, reproduction, disclosure, distribution, or commercial exploitation of CULTURE. 's intellectual property may result in immediate denial of future participation, injunctive relief, monetary damages, recovery of attorney's fees and costs where permitted by law, and any other legal or equitable remedies available.
CULTURE. expressly reserves all intellectual property rights not expressly granted within these Terms & Conditions.

10. TERMINATION & ENFORCEMENT
CULTURE. reserves the right to suspend, restrict, deny, or terminate a participant's access to classes, bookings, services, or facility privileges at any time, with or without prior notice, if a participant violates these Terms & Conditions, poses a safety risk, disrupts the participant experience, or otherwise engages in conduct that is inconsistent with the standards, values, or operations of CULTURE.
Grounds for suspension or termination include, but are not limited to:
• Repeated payment disputes, delinquent balances, or chargebacks.
• Violation of any provision of these Terms & Conditions or other CULTURE. policies.
• Disruptive, abusive, threatening, discriminatory, harassing, or inappropriate conduct toward participants, staff, guests, or visitors.
• Failure to comply with reasonable instructions provided by CULTURE. staff.
• Unauthorized photography, recording, commercial filming, or misuse of CULTURE.'s intellectual property.
• Damage to CULTURE.'s facility, equipment, or property.
• Conduct that jeopardizes the safety, wellbeing, or experience of participants or staff.
• Fraudulent activity, misrepresentation, or misuse of class packs or booking privileges.
In addition to suspension or termination, CULTURE. reserves the right to:
• Restrict booking privileges or participation in services.
• Remove a participant from any class, event, or the facility at any time.
• Recover unpaid balances, damages, repair costs, collection expenses, attorney's fees where permitted by law, and any other amounts owed.
• Pursue any legal or equitable remedies available under applicable law.
Suspension or termination does not relieve the participant of any outstanding financial obligations owed to CULTURE. and does not entitle the participant to any refund, account credit, reimbursement, reinstatement, or restoration of unused class unless otherwise required by law.
CULTURE. reserves the right to refuse future class pack purchases, memberships, event registrations, facility access, or services to any individual whose previous conduct has resulted in suspension or termination.

11. OFFICIAL COMMUNICATION
All official communications from CULTURE. will be delivered through the contact information provided by the participant, including but not limited to email, the CULTURE. app, or other designated communication platforms. Participants are solely responsible for maintaining accurate and current contact information and for reviewing all communications sent by CULTURE.
Participants are deemed to have received all notices, policy updates, billing communications, booking notifications, and other official correspondence sent to the email address or contact information on file, regardless of whether such communications are opened, read, filtered, delayed, or delivered to spam or junk folders.
class pack-related requests, including requests regarding class extensions or other account matters, must be submitted through CULTURE.'s designated communication methods.
Requests submitted by text message, phone call, social media, direct message, or verbal conversation with any CULTURE. Team members will not constitute official notice and will not be accepted or processed.
CULTURE. reserves the right to update its designated communication methods at any time. Participants are responsible for complying with the communication procedures in effect at the time their request is submitted.

12. TERMS & POLICY MODIFICATIONS
CULTURE. reserves the right to modify, amend, update, replace, or discontinue these Terms & Conditions, class pack policies, pricing, services, programs, booking procedures, operating procedures, facility rules, or other business practices at any time in its sole discretion.
Participants will be provided notice of any material changes through the contact information on file or by any other communication method designated by CULTURE.
Unless otherwise stated, all revisions become effective immediately upon the effective date specified in the notice.
A participant's continued purchase, redemption, use of a class pack, participation in classes, access to the facility, or use of any CULTURE. service following the effective date of any revision constitutes acceptance of the updated Terms & Conditions.
CULTURE. is not required to obtain an additional signature or acknowledgment following updates to these Terms & Conditions unless otherwise required by applicable law.

13. SEVERABILITY
If any provision of these Terms & Conditions is determined to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be enforced to the fullest extent permitted by applicable law, and the remaining provisions shall remain valid, enforceable, and in full force and effect.
Any invalid or unenforceable provision shall not affect the validity or enforceability of the remaining provisions of these Terms & Conditions.

14. ACKNOWLEDGMENT & AGREEMENT
By purchasing, redeeming, or participating through a CULTURE. class pack, you acknowledge that you have carefully read, understood, and voluntarily agree to be legally bound by these Terms & Conditions.
You acknowledge that these Terms & Conditions include, but are not limited to, policies regarding class pack purchases, class expiration, booking policies, cancellations, no-show fees, refunds, participant conduct, media consent, intellectual property, assumption of risk, liability waivers, and facility policies.
You authorize CULTURE. to process all authorized charges associated with your class pack purchases and account in accordance with these Terms & Conditions.
You further acknowledge that participation in CULTURE. classes, workshops, events, and other services are voluntary and that you assume all risks associated with participation.
By selecting "I Agree," signing electronically, completing your class pack purchase, redeeming class, or otherwise participating in any CULTURE. service, you acknowledge that you have read, understood, and agree to be legally bound by these Terms & Conditions.

15. GOVERNING LAW
These Terms & Conditions shall be governed by and construed in accordance with the laws of the State of Idaho, without regard to its conflict of law principles. Any legal action arising from these Terms & Conditions shall be brought in the appropriate state or federal court located in Idaho unless otherwise required by applicable law.
