By participating at CULTURE., you agree to the following terms:
1. Participant Eligibility
1.1 Eligibility for Services: Our services are available to individuals who meet CULTURE.’s eligibility criteria.
1.2 Accurate Registration Information: Participants must provide accurate and complete information when registering.
2. Participant Rights & Responsibilities
2.1 Access to Facilities: Participants can access CULTURE.’s benefits and services according to their purchase during operational hours. Class schedule, open gym hours, wellness access, and event availability are subject to change.
2.2 Privacy and Data Protection: Participants are responsible for maintaining the confidentiality of their account credentials and any activity under their account. Participants' personal and payment information will be handled securely and confidentially.
2.3 Feedback Opportunities: Participants have the right to provide feedback or suggestions to improve services. Please send all feedback to hello@culturetwc.com. Communication through social media platforms or texting services are not valid forms of communication.
2.4 Respect the Facility/Equipment, Staff, and Participants: Participants will use gym equipment properly, follow all posted guidelines, and promptly report any malfunctions. Participants will show courtesy to others by respecting fellow participants and staff, including adhering to shared space etiquette such as wiping down equipment after use and storing equipment where it belongs after use. We reserve the right to deny access to any participant who does not comply with our guidelines. Guidelines are subject to change.
2.5 Timely Payments for Monthly Memberships: All membership payments must be paid on time to avoid interruptions in access. We reserve the right to deny access to our facility and our services if you miss any payments.
2.6 Health and Safety: Participants will consult a healthcare provider before starting a new exercise program and use facilities responsibly to minimize the risk of injury.
2.7 Abide by Policies: Participants must follow all gym rules and policies, including personal conduct, and safety instructions.
3. Membership Fees & Renewals
3.1 Payment Schedule: Membership fees are due on a monthly basis. Your auto- renewal date will be the same date you purchased membership.
3.2 Accepted Payment Methods: All payments must be made via our CRM system with either a direct debit ACH or card stored on file. We do not accept cash.
3.3 Late Payments: We reserve the right to charge a late fee of $10 that will be applied to accounts not paid within 2 days of the original due date. Continued failure to pay may result in suspension or termination of membership.
3.4 Additional Fees: Certain programs, classes, or services may require an additional fee. Members will be informed of these costs before participation. There is a 2.5% processing fee for all transactions paid via card. Processing fees are subject to change. Sales tax is charged on all store items.
3.5 Minimum Commitment: A minimum 2-month commitment is required for all recurring memberships before canceling. Cancellation requests may only be submitted after 2 months of membership sent to our email hello@culturetwc.com. Social media communication and texting services are not valid forms of communication.
3.6 Non-Payment Consequences: Failure to pay fees may result in denied access to our facility and our services. We have the right to send any participant to a collection agency, if we deem it necessary.
3.7 Membership Auto-Renewal: Memberships are set to automatically renew at the end of the billing cycle unless canceled in advance per our cancellation policy. Auto-renewal occurs monthly on the same date as the original purchase date.
3.8 Renewal Rates: Membership rates are subject to change. Members will be notified of any price adjustments in advance via marketing communications.
4. Membership Termination
Voluntary Cancellation
4.1 Notice Requirement: Members may cancel their membership by providing written notice sent to hello@culturetwc.com at least 30 days prior to their auto-renewal date. Social media communication or texting services are not valid forms of communication.
4.2 Final payment: If applicable, members are responsible for any remaining balance or fees due up to the cancellation date.
4.3 Refund policy: Membership fees are non-refundable.
Cancellation Due to Special Circumstance
4.4 Medical Reasons: Members may cancel their membership without penalty due to long-term illness or injury, by providing a doctor's note or supporting documentation. Members must send documentation to hello@culturetwc.com. Social media communication or texting services are not valid forms of communication.
4.5 Relocation: Members relocating more than 50 miles from our facility may cancel their membership without penalty with proof of address change. Members must send documentation to hello@culturetwc.com. Social media communication or texting services are not valid forms of communication.

Involuntary Cancellation
4.6 Policy Violations: Memberships may be canceled without refund for violations of gym policies, including but not limited to inappropriate conduct, misuse of equipment, or failure to adhere to our policies/rules.
4.7 Non-Payment: We reserve the right to suspend or cancel membership if payments are not made within 3 days of the due date, following the notification period.

5. Membership Freeze/Holds
5.1 Eligibility for Freezing: Members are eligible to freeze their membership for up to 2 months within a 12-month period. Freezing requests must be submitted to our email hello@culturetwc.com at least 7 days prior to the desired freeze start date.
5.2 Freeze Duration: The minimum freeze period is 21 days, and the maximum cumulative freeze period is 2 months per year. Freeze periods do not need to be consecutive but cannot exceed 2 months in total within a 12-month cycle.
5.3 Freeze Fees: During the freeze period, members will be charged 25% of their regular membership price for the duration of the freeze.
This fee helps maintain administrative services and ensure your spot at the gym upon your return.
5.4 Submitting a Freeze Request: Requests must be made in writing via our email hello@culturetwc.com. The request must include the member’s name, and the desired start and end dates of the freeze, and the reason for freezing.
5.5 Effect on Membership: Freezing temporarily pauses access to the gym and all associated benefits during the freeze period. The membership term will be extended by the duration of the freeze. Membership dues will not be charged during the freeze period.
5.6 Exclusions and Limitations: Freezing cannot be applied retroactively. Freeze periods do not count toward minimum contract commitments. Freezing is not available for members with overdue payments or during promotional periods unless explicitly stated.
5.7 Resuming Membership: Membership will automatically reactivate at the end of the specified freeze period. Members wishing to resume access earlier than planned must notify the gym at least 3 business days in advance.
5.8 Changes to Freezing Policy: The gym reserves the right to modify the freezing policy with prior notice to members.
6. Membership Reactivation
6.1 Rejoining the Gym: Members who have canceled their membership may reapply for membership, subject to availability and payment of any applicable enrollment or initiation fees. We have the right to accept or reject returning participants.
6.2 Previous Balance: Any outstanding balance must be resolved before rejoining.
7. No Refund Policy
General Terms
7.1 Non-Refundable Fees: CULTURE. does not offer refunds for memberships, classes, or services. Once payments are made, they are non-refundable and non-transferable.
7.2 Unused Services: Refunds will not be issued for unused facilities, classes, or services unless specified otherwise in this policy.

Membership Refunds
7.3 No Refund for Prepaid Memberships: Prepaid memberships are non-refundable unless cancellation is due to special circumstances (e.g. medical reasons or relocation). 7.4 Cancellation During “Cooling-Off” Period: Members may receive a full refund if they cancel within the first 3 days of signing up, as long as they have not used the gyms facilities or services. Members must send requests to hello@culturetwc.com. Social media communication or texting services are not valid forms of communication.
Refunds for Special Circumstances
7.5. Medical Exceptions: Members who provide a doctor’s note confirming long-term illness or injury that prevents gym use may be eligible for a prorated refund.
7.6 Relocation: Members moving more than 50 miles from our facility may request a refund for any prepaid, unused portion of their membership with proof of relocation. Event Refunds
7.7 Cancellations by the Gym: If the gym cancels a paid event, class, or program, members will receive a full refund or the option to transfer their payment to a rescheduled event or service.
7.8 Member-Initiated Cancellation: Refund or cancellations by members are subject to a 3 business day notice requirement and may include an administrative fee. We will communicate that fee before processing.

7.9 Request Submission: Refund requests must be submitted in writing to hello@culturetwc.com and include all necessary supporting documents.
7.10 Processing Time: Refunds will be processed within 3 business days of receiving a complete request. Refunds will be issued to the original payment method unless otherwise agreed.
8. Photography & Media
Photography and Videography by Members
8.1 Personal Use Only: Members are permitted to take photographs or videos for personal use. Do not obstruct gym operations, staff, or other participants while filming or taking photos. Any activity that takes up significant space or impacts others’ workouts must be cleared with CULTURE. staff beforehand. Equipment Use: Small tripods, professional cameras, or other equipment are permitted, but must not interfere with the gym environment. Larger setups or extended use must be approved by CULTURE. staff in advance.
8.2 Promotional Content: Filming or photography for promotional purposes (e.g., paid partnerships, brand collaborations, advertisements, or any profit-driven activity) requires prior approval. CULTURE. offers photo/video shoot and influencer pricing for such projects. To inquire, email hello@culturetwc.com with project details and equipment requests. All requests must be sent to hello@culturetwc.com for approval. If promotional content is created without approval, CULTURE. has rights to said content until pricing payment is received.
8.3 Respect for Privacy: All members and participants must respect the privacy of others. Photos or videos that include other individuals may only be taken with their explicit consent.
8.4 Prohibited Areas: Photography or videography is strictly prohibited in the following areas to ensure privacy and comfort: Restrooms, other designated private areas.
Photography and Videography by CULTURE.
8.5 Media Content Creation: CULTURE. may take photos or videos within the facility for promotional, marketing, or operational purposes. This includes, but is not limited to, content for: Social media platforms, advertising campaigns, and website updates.
8.6 Participant Inclusion: By participating you grant your consent for CULTURE. to capture and use photographs, videos, or audio recordings that may include you for promotional, marketing, or educational purposes. This includes, but is not limited to: social media platforms, website and online campaigns, print materials, advertisements, or internal training resources. If you prefer not to be included in such media, please notify a staff member or email hello@culturetwc.com.
8.7 Special Events: During special events, photography and videography may be conducted by the gym or its designated professionals. Signs will be posted to inform members of such activities.

Other Media Terms
8.8 Liability: CULTURE. is not responsible for unauthorized use of images or videos taken by members or third parties. Any concerns about media usage must be submitted in writing to hello@culturetwc.com.
8.9 Copyright and Ownership: All media captured and produced by CULTURE. is the property of CULTURE. and is protected by copyright. Such media may not be reproduced, edited, or used by third parties without permission.
9. Personal Belongings
9.1 Personal Responsibility: Members and participants are solely responsible for their personal belongings while on the gym premises. The gym is not liable for any loss, theft, or damage to personal property. Members and participants are encouraged to safeguard their belongings and use the cubbies provided during their visit.
9.2 Valuables: Members are strongly advised not to bring valuable items (e.g., jewelry, electronics, large amounts of cash) to the gym. The gym will not compensate for the loss of valuables under any circumstances.
9.3 Lost and Found: Items found on the premises will be stored in the gym’s Lost and Found area for a maximum of 14 days. Unclaimed items may be donated to charity or discarded after this period. For inquiries about lost items, please contact the front desk or email hello@culturetwc.com with a description of the item and the date it was lost.
9.4 Prohibited Items: For the safety and comfort of all members, the following items are prohibited in the facility: Hazardous materials or substances, weapons, and any items that may disrupt the gym environment or pose a risk to other members.
10. Health & Safety
10.1 Member Responsibility: At CULTURE., the health and safety of our members, guests, and staff are our top priority. By using our facilities, you agree to exercise within your personal limits, avoid actions that could harm yourself or others, and follow all instructions provided by CULTURE. staff and posted safety guidelines.
10.2 Medical Clearance: Participants are responsible for ensuring they are in good health before participating in any fitness activities. If you have underlying medical conditions, injuries, or other health concerns, consult a medical professional prior to engaging in physical activities. Participants with medical conditions (e.g., heart problems, asthma, diabetes) must inform staff upon joining and update their records as necessary. Participants should carry any required medications (e.g., inhalers, insulin) and notify staff in case of an emergency.
10.3 Injuries and Incidents: Any injuries, accidents, or unsafe conditions should be reported to CULTURE. staff immediately. CULTURE. is not liable for injuries resulting from the misuse of equipment or failure to follow safety guidelines. The gym will document all incidents and may require members to complete an incident report form.
10.4 Equipment Use: To ensure a safe environment, participants must follow proper usage instructions for all gym equipment, return equipment to its designated location after use, and report any malfunctioning or damaged equipment to CULTURE. staff promptly.
10.5 Cleanliness and Hygiene: To maintain a clean and healthy environment, participants must wipe down equipment after use with the provided sanitizing wipes or sprays, wear appropriate workout attire (including clean footwear), and refrain from attending the gym if experiencing symptoms of illness (e.g., fever, cough, or other contagious conditions).
10.6 Prohibited Activity: To ensure the safety of everyone, reckless or dangerous behavior, unauthorized use of equipment, and bringing hazardous materials into the facility are strictly prohibited. The use of performance-enhancing drugs, alcohol, or illegal substances is strictly prohibited. Unsafe behaviors, including horseplay, misuse of equipment, or ignoring safety rules, will result in immediate removal from the premises.
10.7 Liability: By using CULTURE.’s facilities, participants acknowledge and accept that fitness activities carry inherent risks. CULTURE. is not liable for injuries or health complications arising from your participation, except in cases of gross negligence by CULTURE. Staff.
10.8 Emergency Procedures: In the event of an emergency (e.g., fire, medical incident), members must follow staff instructions and evacuate the premises as directed. Emergency exits are clearly marked and must not be obstructed at any time.
10.9 Updates to Policies: The gym reserves the right to update these Health and Safety Terms and Conditions at any time. Members will be notified of significant changes.
11. Use of Facilities
11.1 Access and Membership: Only current members and authorized guests are permitted to use the gym facilities. Members must present their app with a purchase level for access. Participants may only enter the facility under the sponsorship of a member and must adhere to all rules and policies.
11.2 Facility Hours: The gym's operating hours are posted and may be subject to change. Members will be notified of changes in advance whenever possible. Participants must vacate the premises promptly at closing time.
11.3 Proper Conduct: Participants must respect staff, other users, and the facility at all times. Abusive or disruptive behavior will not be tolerated.Participants are responsible for keeping the facility clean and returning equipment to its designated area after use.
11.4 Age Restrictions: Individuals under 18 years of age may only use the facility with parental consent and supervision or as part of an approved program. Certain areas or equipment may be restricted to adults (18+) for safety reasons.
11.5 Prohibited Activities: Smoking, vaping, and the use of alcohol or illegal substances are prohibited on gym premises. Unauthorized commercial activities, including personal training or sales, are not allowed without prior approval.
11.6 Equipment Usage: All equipment must be used as intended and in a safe manner. Participants must follow signage, guidelines, or instructions provided by gym staff regarding equipment use. Use of equipment is on a first-come, first-served basis. Time limits may apply during peak hours.dc
11.7 Facility-Specific Rules: Certain areas (e.g., sauna, cold plunge, yoga studio, boxing ring/area) may have additional rules posted, which must be followed. The boxing ring is off limits to open gym members without approval from staff. The boxing bags, speed bag, and uppercut bag are available for use when a class is not in session. The yoga studio is available to open gym members when a class or event is not in session. Please ask staff if you are unsure. Appropriate attire, including closed-toe athletic footwear, is required in all workout areas.
11.8 Personal Belongings: Personal belongings must be stored in our storage areas(cubbies). Items left unattended may be removed by staff. The gym is not responsible for lost, stolen, or damaged personal property.
11.9 Damage to Property: Members are responsible for any damage caused to the facility, equipment, or property due to negligence or misuse. Repair or replacement costs may be charged to the member.
11.10 Termination of Access: The gym reserves the right to suspend or terminate membership for violations of these terms and conditions or other facility rules. Refunds will not be issued for memberships terminated due to rule violations.
11.11 Changes to Policies: The gym reserves the right to update or amend these Terms and Conditions for Use of Facility at any time. Members will be informed of significant changes.
11. Class Reservations, Gym Attendance, and Cancellation/No-Show Policy
12.1 Class Reservation Policy: Participants are required to reserve their spot for classes in advance through CULTURE.’s booking system (e.g., app or website). Reservations are available on a first-come, first-served basis and may be subject to capacity limits. Participants without a reservation may be accommodated on a walk-in basis if space is available and there is adequate time to set up a reservation, but priority is given to those with confirmed reservations.
12.2 Open Gym Access: Open gym does not require a booking reservation. Simply scan in at the front desk using the barcode located on the main page of the CULTURE. TWC app to gain access. Open gym access is granted to participants and members based on their purchase type. If your current membership does not include open gym access, day passes are available for purchase. Open gym access is during normal operating hours.
12.3 Late Cancellation Policy: Participants must cancel their spot in class at least 8 hours prior to class time to avoid a late cancellation fee. A fee of $8 will be charged to participants who cancel less than 8 hours before the class. If a participant is on a class pack/ class pack membership they will not lose their credit but still be charged the late fee. Repeated late cancellations or no-shows may result in restrictions on future bookings.
12.4 No-Show Policy: Participants who do not attend a reserved class without canceling in advance will be charged a $10 no-show fee.

12.5 Waitlist Policy: If a class is full, participants may join the waitlist. Waitlisted individuals will be automatically added to the class if a spot becomes available and will receive a notification. Those added from the waitlist are subject to the same cancellation policy and fees as confirmed reservations.
12.6 Check-In Procedure: Members must check in at the front desk before class starts. Late arrivals may not be permitted to join the class to avoid disruption to others. For open gym, simply scan in upon arrival; no additional check-in is required beyond scanning the barcode.
12.7 Class Etiquette: To ensure a positive experience for all participants: Arrive on time and be prepared with the necessary equipment or attire. Notify the instructor of any injuries or modifications needed before the class begins. Follow the coach’s guidance and respect the space of other participants.
12.8 Coach Substitutions and Schedule Changes: CULTURE. reserves the right to substitute class instructors or modify the class schedule as needed. Members will be notified of significant changes via social media platforms, email or the CULTURE. App.
12.9 Special Events: Some classes, events, or workshops may require separate registration or an additional fee. Details will be provided at the time of booking.
12.10 Equipment Policy: For our boxing (GRIND.) classes, closed hand boxing gloves and handwraps are required to participate in class. If you do not have your own we provide glove rentals for $3 and handwraps for purchase for $12. For our yoga(FLOW.)/pilates-inspired classes(ALIGN.) we require a yoga mat to participate in class. If you do not have your own we provide mat rentals for $3. Prices are subject to change, and will be communicated accordingly.
13. Communication
13.1 Participant Contact Information: Members are required to provide accurate and up-to-date contact information, including email address and phone number, to ensure effective communication. It is the responsibility of the member to notify the gym of any changes to their contact information.
13.2 Purpose of Communication: Members may select their preferred communication channels, such as email, SMS, or app notifications, where available. The gym may contact members for purposes including, but not limited to:

Promotions, offers, or new services

Safety alerts or emergency notifications
13.3 Opting In and Out of Marketing Communications: Participants can opt in to receive promotional materials or updates about gym services and offers. Participants may opt out of marketing communications at any time by using the unsubscribe link in emails or contacting the gym directly. Opting out of marketing does not affect essential communications (e.g., billing notices, safety alerts).
13.4 Responsibility for Messages: The gym is not responsible for missed communications resulting from incorrect contact details or failure to check messages. Participants are encouraged to regularly review messages to stay informed about gym updates.
13.5 Participant Communication with Gym Staff: Participants are expected to communicate with staff respectfully and courteously. Abusive or inappropriate communication will not be tolerated. Questions, concerns, or feedback should be directed to designated contact points, such as management or our email hello@culturetwc.com
13.6 Social Media and Public Communication: Participants are encouraged to engage with the gym’s social media platforms but must refrain from posting inappropriate or offensive content. Any concerns regarding the gym should be addressed directly with management rather than through public forums.
13.7 Emergency Communication: In the event of an emergency, the gym may use all available communication channels to notify members, including SMS, email, or app notifications. Members are expected to comply with all instructions provided during emergencies.
13.8 Confidentiality and Privacy: The gym will not share member contact information with third parties without consent, except as required by law. All communications will adhere to the gym’s Privacy Policy.
13.9 Changes to Communication Policies: The gym reserves the right to update these Terms and Conditions for Communication. Members will be notified of significant changes via our marketing communication.
14. Amendments
14.1 Right to Amend: The gym reserves the right to amend, update, or modify its policies, terms, and conditions at any time to ensure compliance with applicable laws, enhance operations, or improve member experience.

14.4 Member Acknowledgment: Continued use of the gym facilities or services after an amendment becomes effective constitutes acceptance of the updated terms and conditions. Members are encouraged to review the updated terms and contact the gym with any questions or concerns.
14.5 Special Circumstances: In cases where amendments involve significant changes to membership pricing or benefits, members may be offered the option to cancel their membership without penalty before the changes take effect. Specific terms regarding cancellations or refunds will be included in the notification.
14.6 Access to Updated Terms: The most current version of the gym’s terms and conditions will always be available on the gym’s website. Participants are encouraged to review the terms periodically to stay informed about any updates. Participants can reach out to hello@culturetwc.com for a copy if needed.
14.7 Dispute Resolution: If a member disagrees with an amendment, they must notify the gym in writing within 14 days of receiving the notification. Disputes will be handled in accordance with the gym’s dispute resolution policies.
14.8 Applicability: All amendments will apply to current and future members unless otherwise specified.
