CULTURE. Official Terms & Conditions

By participating at CULTURE., you agree to these detailed, legally binding Terms & Conditions:

1. Participant Eligibility

1.1 Age Requirement
Participants must be at least 18 years old to enroll independently. Individuals under 18 years old may participate in CULTURE. services only if they are part of a dedicated program, event, or private training session. Parental or legal guardian consent is required for all participants under 18. Minors may be restricted from certain areas or equipment based on safety regulations and program guidelines.

1.2 Health & Medical Requirements
Participants are responsible for ensuring they are in good physical condition before engaging in any physical activities at CULTURE. Individuals with pre-existing medical conditions—including but not limited to heart disease, high blood pressure, orthopedic injuries, or other serious health concerns—must obtain medical clearance from a licensed healthcare provider before participating. By enrolling, members acknowledge that they assume full responsibility for any injuries, conditions, or adverse effects resulting from participation.

1.3 Right to Refuse Service
CULTURE. retains the unconditional right to refuse, deny, revoke, or terminate membership or participation at its discretion due to noncompliance with policies, misconduct, safety concerns, or misrepresentation of eligibility.

1.4 Accurate Registration Information
Participants must provide accurate, complete, and truthful information during registration. Any misrepresentation, falsification, or failure to disclose relevant information may result in immediate suspension or termination of membership without refund. CULTURE. reserves the right to request proof of eligibility at any time, including but not limited to government-issued identification, medical clearance, or residency verification.

 

2. Participant Rights & Responsibilities

2.1 Facility Access
Facility and service access is granted according to membership tier or purchased package. CULTURE. reserves the right to adjust schedules, availability, or facility access without prior notice due to operational needs.

2.2 Privacy & Data Protection
Participants must secure their account credentials and personal information. CULTURE. adheres strictly to data protection practices as outlined in our detailed Privacy Policy, which is available on our website or upon request via email.

2.3 Feedback Opportunities
Feedback or suggestions must be submitted to hello@culturetwc.com to ensure proper documentation and response. Social media or text messages are not recognized as valid communication due to lack of official tracking and reliability. Members can expect a response within 3-5 business days.

2.4 Respect for Facility, Staff, and Participants

  • Facility: Participants must use all equipment properly, return items to their designated locations after use, and wipe down equipment after workouts. Vandalism, damage, or failure to maintain cleanliness may result in penalties, suspension, or termination of membership. Members are prohibited from modifying, relocating, or reserving gym equipment for personal use outside of approved class or training sessions.

  • Staff: Verbal abuse, intimidation, harassment, or refusal to follow staff instructions will not be tolerated. Staff members have the right to enforce gym policies, and failure to comply may result in immediate removal from the premises and permanent revocation of membership without refund. Only CULTURE.-approved trainers and coaches may provide instruction or personal training services within the facility. Unauthorized personal training, coaching, or sales of fitness-related services by members is strictly prohibited.

  • Participants: Participants must conduct themselves in a respectful manner at all times. Disruptive behavior, including but not limited to excessive noise, aggressive conduct, or disrespecting another participant’s space, is grounds for disciplinary action, including temporary or permanent suspension. Participants must follow established workout area guidelines, including designated areas for lifting, stretching, and group workouts, to ensure a smooth and safe experience for all participants.

2.5 Personal Belongings & Locker Storage
CULTURE. is not responsible for any lost, stolen, or damaged personal belongings. Participants should use designated storage areas and secure valuables at their own discretion. Items left unattended in common areas may be removed by staff. CULTURE. maintains a lost and found area where recovered items will be held for 14 days. After this period, unclaimed items will be donated or discarded. Participants may inquire about lost items at the front desk.

2.6 Emergency & Incident Reporting

CULTURE. staff are not medical professionals. In the event of a medical emergency, CULTURE. will contact emergency services but is not responsible for medical care, treatment decisions, or costs incurred. Participants acknowledge that CULTURE. may not have an Automated External Defibrillator (AED) or medically trained personnel on-site at all times.

All injuries, accidents, or unsafe conditions must be reported to CULTURE. staff immediately. Participants may be required to complete an incident report for documentation purposes. CULTURE. reserves the right to take necessary action to ensure the safety and well-being of all participants and staff, including contacting emergency services if deemed necessary. CULTURE. is not responsible or liable for any costs incurred from emergency medical services or treatments provided.

2.7 Prohibited Conduct & Substances
The use, possession, or distribution of alcohol, illegal drugs, or performance-enhancing substances is strictly prohibited on CULTURE. property. Any violation of this policy may result in immediate termination of membership without refund and potential legal action if applicable.

2.8 Proper Attire & Hygiene
Participants are required to adhere strictly to appropriate athletic attire standards, as clearly specified for each activity. Participants agree to follow additional guidelines and rules specific to each activity or modality, which are available on our website or upon request. Compliance with hygiene guidelines, including sanitizing equipment after use and not participating when contagious, is mandatory.

2.9 Cell Phone & Recording Policy

To maintain a focused and respectful environment, phone calls are not permitted in workout areas. Photography and video recording are allowed only in designated areas or with prior approval. Members must respect the privacy of others and avoid capturing individuals without their consent.

  • Personal Use Recording: Members are permitted to take photos and videos for personal use, such as sharing workouts on social media, provided they do not disrupt others or obstruct gym operations. Members must ensure that recordings do not capture individuals without consent and must follow CULTURE.'s community standards.

  • Professional & Commercial Recording: Any recording intended for commercial purposes, including but not limited to paid social media content, sponsorships, advertisements, or brand collaborations, requires prior written approval from CULTURE. CULTURE. reserves the right to charge a location fee or require adherence to specific brand guidelines for professional content creation. CULTURE. also offers a Rental Agreement for those who wish to reserve the gym for exclusive use for filming or photography. This agreement outlines the terms, pricing, and availability for professional recording sessions. For inquiries or to book a rental, members must contact hello@culturetwc.com.

  • Equipment & Space Usage: Members using tripods, professional cameras, or other recording equipment must receive approval from staff to ensure minimal disruption to the gym environment.

  • Violation of Recording Policy: Unauthorized professional recording, failure to obtain proper consent, or disruptive recording practices may result in warnings, suspension of filming privileges, or membership termination.

2.10 Cancellation & No-Show Policy
Members must cancel class reservations at least 12 hours before the scheduled time to avoid a $10 late cancellation fee. If a member books a class in the app and does not show up, a $15 no-show penalty will be applied. Three (3) or more no-shows within a 30-day period will result in a temporary suspension of booking privileges for seven (7) days

2.11 Guest & Visitor Policy
Guests must be accompanied by an active member, complete the official liability waiver before each visit, and pay applicable fees. CULTURE. reserves the right to deny guest access for any reason.

2.12 Equipment Reservation & Usage Limits
Equipment usage during peak hours is limited to 30 minutes per participant to ensure fair access. Peak hour time limits will be enforced by CULTURE. staff. Refusal to comply may result in suspension of booking privileges or membership warnings. Our boxing ring usage is restricted to scheduled classes or authorized reservations. 

2.13 Timely Membership Payments

Unpaid balances exceeding 30 days may be sent to a collections agency. CULTURE. reserves the right to report unpaid balances to credit agencies if necessary.
Membership payments must be timely. Payments overdue by two days incur a $25 late fee. Continued non-payment after seven (7) days may result in membership suspension, termination, and/or submission to a collections agency. CULTURE. reserves the right to deny access to services, facilities, or booking privileges until outstanding balances are paid in full.

 

3. Liability Waiver & Assumption of Risk

Participants acknowledge that CULTURE. services—including but not limited to Boxing, Pilates, Strength training, Saunas, Cold Plunges, and other fitness and wellness activities—carry inherent risks. By enrolling, participants voluntarily assume full responsibility for any injury, medical condition, or adverse effect resulting from participation.

Participants release and discharge CULTURE., its owners, employees, agents, contractors, and affiliates from any claims, liabilities, or damages related to their participation, whether caused by negligence or otherwise. Members must inform CULTURE. staff of any medical concerns before engaging in activities.

 

4. Membership Cancellation & Refund Policy

Members agree not to dispute or initiate chargebacks for payments made to CULTURE. Disputed transactions will be subject to legal action, and any chargeback fees incurred by CULTURE. will be the responsibility of the member.
Membership cancellations must be requested via email at least 30 days before the next billing date, and memberships require a minimum commitment of two months before cancellation is permitted. CULTURE. does not offer refunds for prepaid memberships, services, or unused packages, except where explicitly approved by management. Failure to submit a cancellation request at least 30 days before the next billing cycle will result in an additional monthly charge. No refunds will be issued for late cancellation requests.

 

5. Automatic Renewal & Billing
Memberships automatically renew on the same day each month unless explicitly canceled following the outlined procedure. Participants authorize automatic recurring billing to their provided payment method. Removing a payment method or failing to update billing information does not constitute a valid cancellation, and unpaid balances remain the responsibility of the member. All transactions, including membership fees, class packages, and retail purchases, are subject to a 2.5% processing fee.

 

6. Membership Holds & Freezes

Participants may request one membership freeze annually for up to 3 months with a $15 monthly fee. If the freeze request is due to a medical reason, the fee will be waived, but medical documentation from a licensed provider is required.

In cases of long-term injury, surgery recovery, or pregnancy, members may request an extended hold beyond the standard freeze period. All freeze requests must be submitted via email for approval and are subject to CULTURE.’s discretion.

 

7. Trainer & Instructor Liability

CULTURE. employs both staff and independent fitness professionals, trainers, and wellness practitioners. Independent contractors operate separately from CULTURE. employees and are not under CULTURE.'s direct supervision or control. CULTURE. is not liable for injuries, negligence, or damages resulting from services provided by independent trainers. Members engaging with independent trainers do so at their own risk.

 

8. Intellectual Property Rights
All CULTURE. branding, content, intellectual property, and training methodologies remain proprietary and are protected under applicable copyright, trademark, and intellectual property laws. Unauthorized use, distribution, reproduction, modification, or commercialization of CULTURE. materials, programs, logos, branding, methodologies, or any other proprietary content is strictly prohibited and will be pursued legally.

Members, trainers, contractors, and visitors are prohibited from using CULTURE.’s branding, concepts, or methodologies for any commercial, educational, or competitive purposes outside of CULTURE. without prior written approval. Any attempt to replicate, rebrand, or use CULTURE.’s proprietary materials in another gym, program, or business, whether for profit or personal use, will be subject to legal action.

CULTURE. reserves the right to revoke access to its facilities, programs, and materials if a participant, member, or contractor is found to be in violation of this policy. If you wish to use CULTURE. intellectual property for educational, business, or marketing purposes, you must request written permission by contacting hello@culturetwc.com.

 

9. Modification of Terms

No verbal agreements, representations, or assurances by CULTURE. staff or representatives shall supersede these Terms & Conditions. Any modifications must be made in writing and officially communicated by CULTURE.
CULTURE. reserves the right to modify these Terms at any time. Changes will be communicated through email and/or website updates. Continued participation constitutes acceptance of the revised Terms.

 

10. Dispute Resolution & Arbitration
10.1 Any unresolved disputes between CULTURE. and a participant, member, or third party will be resolved exclusively through binding arbitration administered by the American Arbitration Association (AAA), conducted in Idaho.

The arbitration will be conducted by a single, neutral arbitrator, mutually selected by both parties. If an agreement on the arbitrator cannot be reached, the AAA will appoint one in accordance with its rules. The arbitration shall be conducted in accordance with the AAA's Commercial Arbitration Rules and shall be final and binding upon both parties.

Class-Action Waiver: By agreeing to these Terms & Conditions, participants waive any right to file or participate in a class-action lawsuit or jury trial against CULTURE. All claims must be brought individually, and no claims may be consolidated or combined with another party's claim.

Legal Costs & Attorney’s Fees: The prevailing party in arbitration shall be entitled to recover reasonable attorney’s fees and legal costs associated with the dispute.

Exceptions: This arbitration clause does not apply to claims related to CULTURE.’s intellectual property rights, trade secrets, trademarks, copyrights, or other proprietary rights, which may be pursued directly in a court of law without arbitration.

The arbitrator's decision shall be final and enforceable in any court of competent jurisdiction. By accepting these Terms & Conditions, participants expressly waive their right to a trial in court.

10.2 Violation of Terms. CULTURE. reserves the right to take appropriate action, including but not limited to issuing warnings, suspending membership privileges, revoking access, or terminating membership without refund if a participant violates any of these Terms & Conditions. CULTURE. retains sole discretion to determine the severity of the violation and the corresponding consequence.

Additional Clauses:

  • Photography & Promotional Use: Participants consent to photography or videography for promotional purposes unless explicitly opted out in writing via email. CULTURE. reserves the right to use these images or recordings for marketing, advertising, and promotional materials across various platforms, including social media, websites, and print. Participants who do not wish to be recorded or photographed must submit an opt-out request to hello@culturetwc.com prior to participation in any CULTURE. activities.

  • Accessibility & Accommodation Policy: CULTURE. strives to provide reasonable accommodations for individuals with disabilities in accordance with the Americans with Disabilities Act (ADA). Participants requiring accommodations must submit requests in advance via email to hello@culturetwc.com. Accommodations will be assessed on a case-by-case basis and must not create an undue hardship, pose a safety risk, or fundamentally alter CULTURE.’s services. Medical documentation may be required for accommodation requests.
